Umbrabyte Apps operates as a registered sole proprietorship (profesional autónomo) under the laws of the Kingdom of Spain and the European Union, specializing in native mobile software engineering and digital interface design.

2. Intellectual property & license

Unless otherwise indicated, all content on this website and in our applications—including but not limited to source code, user interface designs, visual layouts, icons, typography, trademarks, logos, texts, documentation, and media assets—is the exclusive intellectual property of Cristian Donet Segura and is protected by Spanish, European, and international copyright and industrial property laws.

• Grant of License: When you download an application from an official app store (e.g. Google Play Store), you are granted a personal, non-exclusive, non-transferable, revocable license to use the software on your compatible device for personal or internal business purposes in accordance with these terms.
• Restrictions: You may not copy, modify, distribute, sell, sublicense, reverse-engineer, decompile, or extract source code from our software or website content without prior express written authorization.

3. Acceptable use policy

You agree to use this website and our applications strictly for lawful purposes. You must not:

• Attempt to interfere with, damage, disrupt, or gain unauthorized access to our servers, networks, or connected infrastructure.
• Use automated scrapers, crawlers, bots, or extraction scripts in a manner that imposes an unreasonable burden on our hosting infrastructure.
• Transmit malware, viruses, worms, or malicious code.
• Misrepresent your affiliation with Umbrabyte Apps or forge headers/identifiers.

4. In-app purchases, subscriptions & billing terms

Our applications may offer optional premium features, in-app purchases, or auto-renewing subscriptions (such as PRO tiers):

• Storefront Governance: All payments, currency conversions, applicable sales taxes (VAT/GST), and digital receipts are processed directly by the official app storefront operator (Google Play Store operated by Google LLC / Google Ireland Limited).
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (e.g. monthly or yearly) unless cancelled at least 24 hours prior to the renewal date.
• Cancellation: You may cancel or manage subscriptions at any time directly within your Google Play Store account settings (Google Play > Payments & subscriptions). Cancellation takes effect at the end of the current paid billing period.
• Refunds: All refund requests are governed by the official Google Play Refund Policy.
• Free Core Guarantee: Core offline functionality of our applications remains accessible without requiring ongoing subscriptions.

5. Disclaimer of warranties

This website, its content, and all applications are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted operation.

While we strive for technical excellence, we do not warrant that our software will be completely error-free, uninterrupted, or compatible with every hardware and operating system configuration.

6. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Cristian Donet Segura (Umbrabyte Apps) be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, loss of data, loss of business goodwill, work stoppage, or device malfunction—arising out of or in connection with your use of or inability to use the website, applications, or services.

Statutory Exclusions: Nothing in these terms excludes or limits liability for death or personal injury resulting from negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under mandatory consumer protection laws of your jurisdiction.

7. Consumer protection & right of withdrawal (EU / Spain)

If you are a consumer residing within the European Union, you benefit from statutory consumer protections under Directive 2011/83/EU and the Spanish Royal Legislative Decree 1/2007 (TRLGDCU).

In accordance with EU consumer rules for digital content, when you purchase in-app digital content or subscriptions through Google Play and consent to immediate performance, you acknowledge that your statutory 14-day right of withdrawal may expire upon the commencement of digital delivery, as governed by Google Play Store terms.

9. Governing law and jurisdiction

These terms and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of the Kingdom of Spain, without regard to conflict of law principles.

Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Courts of Castellón de la Plana, Spain, without prejudice to any mandatory statutory forum rights granted to consumers under applicable consumer protection legislation.
